Terms & Conditions

Definitions


Best Flexible Rate means a nightly room rate for a Participating Hotel that is available to the general public that does not require pre-payment and is the lowest generally available nightly room rate for that Participating Hotel offered online.


Black (top-tier) Member means a Member who has been invited to Black Membership status as outlined in these Terms and Conditions.


Conference and Events means certain meetings, conferences and events held at Participating Hotels.


EVT Hotel Group means EVT Ltd, the Program Operator and their related bodies corporate that own, operate, manage or brand license hotels.


EVT Hotel Websites means www.evtstays.com, www.rydges.com, www.qthotels.com, www.aturahotels.com, www.independentcollection.com.au and such other websites managed by the EVT Hotel Group from time to time.


EVT Stays is the name of EVT’s hotel loyalty program, as described in these Terms and Conditions.


EVT Stays Reward Points means Reward Points earned when a Member books accommodation at a Participating Hotel on a EVT Hotel Website, or within a Participating Hotel, or via selected Wholesale Channels either direct to the Wholesale Agent or via the online agent portals, as outlined in these Terms and Conditions by a Member.


Free Room Night means where a Member spends a night at a Participating Hotel using EVT Stays Reward Points and is not required to pay for the cost of the room. For more details see Tiers, Benefits, Points & Participating Hotels.


Hotel Room Night and Hotel Visit: A Hotel Room Night means each individual night of a stay at a Participating Hotel. A ‘Hotel Visit’ means all consecutive nights that a Member stays at a Participating Hotel even if they have checked out and checked back in for consecutive nights. For example: (i) if a guest stays for five consecutive nights this will be recorded as one ‘Hotel Visit’ and five ‘Hotel Room Nights’; (ii) if a guest stays for one night only, this will be counted as both one ‘Hotel Visit’ – and one ‘Hotel Room Night’; and (iii) if a guest stays for one night, then checks out, then checks back in to stay for the subsequent night and then checks out this will be recorded as one ‘Hotel Visit’ – and two ‘Hotel Room Nights’.


Member means an individual that has been approved by the Program Operator to be an Individual Member in the Program.


Member Discount means a percentage discount, as determined by the Program Operator, that is available to individual Members when they book as a Member at evtstays.com or at another EVT Hotel Website.


Membership means membership of the Program by a Member.


Membership Card means the card that is digitally downloaded by each Member.


Membership Number means the number that is provided to a Member.


Membership Profile means the details of the Member held online at evtstays.com.


Member Rate means a special hotel nightly room rate that is only available to individual Members staying at a Participating Hotel.


Participating Hotels means a hotel or resort which operates under any of the following brands: Rydges, QT, Atura and Independent Collection by EVT, located in Australia, New Zealand or Singapore, or such other brand as specified by the Program Operator from time to time (and which is participating in the Program). Note LyLo hotels are not currently Participating Hotels, and their involvement is coming soon to EVT Stays. For the current list of Participating Hotels, including exclusions and variations please see view this page, which is updated from time to time.


PGR means the Priority Guest Rewards Program, which was the previous name of EVT Stays until 20 August 2024, as described in these Terms and Conditions.


Platinum EVT Stays Member means an individual Member who has attained Platinum Membership status as outlined in these Terms and Conditions.


Points Balance means the amount of available EVT Stays Reward Points in a Member’s account.


Priority Guest Rewards was the previous name of EVT Stays until 20 August 2024, as described in these Terms and Conditions.


Program or EVT Stays means the EVT Stays Program described in these Terms and Conditions.


Program Benefits means benefits and rewards that accrue to a Member in the Program as set out in the Tiers, Benefits, Points & Participating Hotels.


Program Operator means Rydges Hotels Ltd (ACN 050 035 268).


Program Partner means any Participating Hotel or other entity specified by the Program Operator who has agreed to participate as a Program Partner in the Program to offer Benefits to Members from time to time.


Qualifying Member Rate means the rate for individual Members where the booking has been made as set out in Clause 4.1.2 and the Hotel Visit is subsequently completed and paid for in full. Certain group bookings and other special promotional rates may not be a Qualifying Member Rate. The person making any booking should check with the relevant Participating Hotel or contact member services at [email protected] to confirm that the rate they are booking is a Qualifying Member Rate and/or if that booking will be eligible for any or all Member Benefits.


Qualifying Member Visit means a Hotel Visit which meets the criteria set out in these Terms and Conditions.


Terms and Conditions mean these terms and conditions which apply to Members of the Program.

1.1 About these terms

These Terms and Conditions are for the EVT Stays Program. Your participation in the Program will be governed by these Terms and Conditions. It is a Member’s responsibility to read and understand them. We ask that you read them carefully.

1.2 When these terms apply to you

These Terms and Conditions apply to you if you are a Member of the Program. Use of your Membership Card or your Membership Number signifies your acceptance of the Terms and Conditions

1.3 Changes from time to time

The Program Operator may amend these Terms and Conditions from time to time in order to reflect changes to the Program or as required by applicable law. Any amendments to these Terms and Conditions which materially impact your rights or obligations will be notified to you by email.

1.4 Types of Memberships

Membership may be held by an individual.

Memberships will fall into one of four tiers:

  • Entry-level Silver Tier EVT Stays Member
  • Gold Tier EVT Stays Member
  • Platinum Tier EVT Stays Member
  • Top-tier Black EVT Stays Member

1.5 Cost

The EVT Stays Program is free to join.

1.6 Membership profile

A Member can update their Membership Profile online at www.evtstays.com.

1.7 Marketing & Communications

By joining the Program, Members can choose to “opt-in” to receive special offers, marketing and Program information via email, SMS, App and website communications. During their Membership, Members may also elect not to receive email, SMS, App and website communications by using the unsubscribe functionalities within email, SMS, App and website communications respectively or by contacting member services at [email protected]

1.8 Privacy

As a EVT Stays Member you consent to the collection, use and disclosure of your personal information in accordance with the Program Operator’s Privacy Policy available at evtstays.com/privacy/

2. Program Partners

The Program Partners (including the list of Participating Hotels) may vary from time to time. Members should check Tiers, Benefits, Points & Participating Hotels for the current listing of Program Partners.

3. Membership

3.1 General Criteria:

Membership is for a person and provides that person with certain benefits as set out in these Terms and Conditions. The following general criteria apply in order to be a Member:

  1. The Program Operator has approved the individual’s Membership application;
  2. The individual must reside in a country that does not prohibit participation in a program like the EVT Stays Program;
  3. The individual must be 18 years of age or older; and
  4. The individual must provide and maintain details of a valid and unique email address for their Membership at the time of joining and for their period of Membership.

3.2 Criteria for different tiers of Membership:

All Members will fall into one of four tiers of the Program:

  • Entry-level Silver Tier EVT Stays Member
  • Gold Tier EVT Stays Member
  • Platinum Tier EVT Stays Member
  • Top-tier Black EVT Stays Member

Members should check Tiers, Benefits, Points & Participating Hotels for the criteria to qualify for each tier.

3.3 Term of Membership

The term of Membership is from the date of enrolment until either:

  1. termination of Membership by the Member; or
  2. termination of Membership by the Program Operator,

in accordance with clause 6 of these Terms and Conditions.

4. Program Benefits

This section sets out the Program Benefits that are available to Members.

Please note some hotels do not participate in the EVT Stays program.

Please note that some hotels are not full Participating Hotels within the EVT Stays program.

Members should check Tiers, Benefits, Points & Participating Hotels for a full list of Participating Hotels and the most up to date benefit exclusions and variations.

4.1 General

4.1.1. These Terms and Conditions incorporate the current Tiers, Benefits, Points & Participating Hotels. We recommend that Members regularly check the Tiers, Benefits, Points & Participating Hotels to be aware of all current offers and terms. Any material changes to Program Tiers, Benefits or Points will be notified to Members by email.

4.1.2 The full range of Member Benefits will only be available if the Member makes their reservation at a Participating Hotel using one of the following methods: (i) Direct online at a EVT Hotel Website; (ii) Direct online at the website of the Participating Hotels; (iii) Direct to a Participating Hotel via telephone, email or in-person; or (iv) via certain Wholesale Channels determined by the Program Operator, either direct to the Wholesale Agent or via the online agent portals, in conjunction with your Membership profile.

4.1.3 Where a Member is staying at a Participating Hotel as part of an airline or transport crew arrangement or as part of a convention or conference group, sporting team, education group or other group bookings such as an inbound tour group, the Program Benefits will not be available at the relevant Participating Hotel. Members may confirm with the Participating Hotel in advance or at the time of check-in if their stay or spend is eligible for Program Benefits.

4.1.4 Certain Program Benefits are not available to Members who are staying at a Participating Hotel on a Free Room Night (i.e. Reward Night Booking or any other free night). see Tiers, Benefits, Points & Participating Hotels.

4.1.5 Restrictions apply on the number of rooms booked per night for an individual Member to receive the applicable Member Rate and corresponding EVT Stays Rewards Points. The Member must also be an ‘in-house’ staying guest as part of each relevant booking and pay for all rooms on a single account folio. 4.2 Membership Program Benefits

5. Membership Card, Membership Number and Activation of Membership

5.1 The Program Operator will issue Members with a EVT Stays digital Membership Card

Following the Program Operator accepting a Member’s application for Membership, the Program Operator will provide that Member with a Membership Card. Each card has a unique Membership Number. The digital Membership Card is not transferable and must not be used by any person other than the Member to secure any of the Program Benefits.

5.2 Activation of Membership

If a Member has completed an online application form (via the Program website or via the Hotel Sign-up Terminal), the Member will be provided a Membership Number. Once a person has this, the person will be classified as a Member and can use the Membership Number to obtain certain Program Benefits and earn Reward Points. The Membership is considered active as soon as an eligible night transaction is recorded against the Membership Number.

Regardless of the method of enrolment, the Program Operator will email the Membership Card directly to the verified email address that was supplied at the time of sign up. Once the Member receives the email, they will need to download their digital Membership Card. This can be done via Apple Wallet, Google Pay or by downloading a PDF depending on the version of phone the Member wishes to download their card onto.

5.3 Security of Membership Card and Membership Number

The Member must keep the digital Membership Card secure at all times. If the Membership Card is lost or stolen, the Member must immediately advise the Program Operator.

5.4 Membership Cards for Silver, Gold, Platinum and Black tier EVT Stays Members

  1. Each Silver, Gold, Platinum & Black tier EVT Stays member will receive a distinctive digital Membership card that features an expiry date. After that expiry date, the card will not be valid.
  2. If, after the expiry date on the Card the Member still meets the criteria to retain their Gold tier status, Platinum tier status or is permitted to retain their invitation-only Black tier status, the Program Operator will extend the expiry date on the existing digital Membership Card at the same tier level. The digital card does not need to be re-downloaded and will update automatically. If the Member does not meet the criteria to be retained at their present tier, the digital Membership Card will automatically update to reflect one tier lower than their prior tier status. If the Member meets the criteria to move to a higher tier, the digital Membership Card will automatically update to reflect the higher tier for which they now qualify. Note that if the Member has printed off the PDF version of the card, then they will need to re-download and re-print the card to reflect any updated tiers or expiry dates.
  3. The Member’s existing balance of EVT Stays Reward Points is retained if and when a Member changes status from any one tier to another.

5.5 Existing PGR Membership Cards

Existing Priority Guest Rewards (PGR) physical and digital Membership Cards will continue to be accepted provided the individual’s Membership is still active at the respective tier and the card has not expired. Once these cards have expired, Members are required to download their new EVT Stays digital Membership Cards by logging in to their account at evtstays.com. There are no longer physical membership cards for any tier.

5.6 Use of accurate Member details

A Member must accurately record or quote their Membership name and number when making bookings or seeking to receive the Program Benefits. If they do not, or any third party making a booking on their behalf does not, the Program Operator cannot ensure that the Program Benefits will be received by the Member. Membership points & eligible stays will only be awarded to eligible bookings made on www.evtstays.com or an EVT Hotel Website in conjunction with the Membership profile. Members can receive EVT Stays Reward Points on bookings made through Wholesale Agents, however the Membership number must be given to the agent at the time of booking and confirmed on check in. Where the Membership number is not supplied to the agent at the time of booking and it is not confirmed on arrival at the Participating Hotel, the booking will not be eligible for EVT Stays Reward Points and cannot be claimed.

The Program Operator shall be entitled to assume that any person that purports to be a Member and provides (whether in person or through any electronic, telecommunications or other media) the Membership name and number to the Program Operator is in fact the Member. The Program Operator shall be entitled to:

(i) reveal to any such person any and all information relating to their Membership and Membership bookings, and
(ii) treat and act on any request of such a person with respect to any other matter regarding the Program without taking any further steps to verify the identity of the person.

6. Terminations and Liability

6.1 Misuse of Membership

If the Program Operator decides, on reasonable grounds, that a Member is using their Membership in an abusive or fraudulent way, has committed a material breach of these Terms and Conditions, has committed any unlawful act, causes wilful damage to a Participating Hotel (including property or equipment) or acts in an aggressive, threatening or disrespectful way to any hotel staff working at a Participating Hotel, the Program Operator may at its election:

  1. immediately terminate the Membership;
  2. suspend a Membership temporarily until further notice;
  3. reverse or cancel any EVT Stays Reward Points and, or other Program Benefits that a Member has accrued; or
  4. refuse to honour the redemption of EVT Stays Reward Points.

6.2 Termination on death of person who is Member

On the death of a person who is a Member the Membership will automatically terminate.

6.3 Termination of Program

The Program Operator reserves the right to terminate the Program however the Program Operator will give Members reasonable prior notice of any such termination.

6.4 Consequences of termination

All benefits, offers and rewards will be forfeited on termination of a Membership or termination of the Program. To the extent permitted by law (and without limiting the application of the Australian and New Zealand Consumer Law and the Consumer Guarantees), the Program Operator, the EVT Hotel Group, the Program Partners and each Member will have no further liability under the Program or these Terms and Conditions on termination of the Member’s membership or on termination of the Program.

6.5 Liability

To the extent permitted by law (and without limiting the application of the Australian and New Zealand Consumer Law and the Consumer Guarantees), the Program Operator, the EVT Hotel Group, the Program Partners and each Member:

  1. excludes all warranties;
  2. excludes liability for any indirect or consequential loss or damage of any kind including loss of profits and loss of revenue; and
  3. limits their liability to any one or more of the following:
    1. in relation to goods, replacing or repairing the goods or supplying an equivalent item, or paying the costs or replacing, repairing or hiring an equivalent item; or
    2. in relation to services, the re-supply of the services or payment of the cost of having the services re-supplied.

7. General

7.1 Governing law

These Terms and Conditions of the Program are governed by the laws in force in New South Wales. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

7.2 Tax liability

Rewards and offers that are available to Members may be subject to tax liability. The Member is responsible for those taxes.

9. Cancellation of Member Bookings

You may generally cancel your reservation up to 2pm one day prior to arrival with no cancellation fee. After 2pm one day prior to the day of arrival, a cancellation fee of the first night’s package price will be charged.

Additional terms and conditions apply for cancellation of advance purchase or prepaid individual rooms, group and conference and event bookings and are subject to special event block out dates as specified by each Participating Hotel. 10. Credit Cards

By agreeing to these Terms and Conditions you acknowledge that unless we come to an alternative arrangement with you or the named guest, then the credit card provided will be used for payment of all accommodation and ancillary costs charged to the room, for any damage to the room during the stay, and for any cancellation or non-arrival fees.

11. Check In and Check Out Times

  • For Participating Hotels in Australia, check-in is generally from 2pm and check-out is generally before 11am.
  • For Participating Hotels in New Zealand, check-in is generally from 3pm and check-out is generally before 10am.

Earlier arrival and later departure times can be arranged, subject to availability, however applicable day-use charges may also apply.
